Maryland SB 403/HB 5 Enhanced Under-insured Motorist Coverage Enacted

Maryland SB 403/HB 5 establishes enhanced underinsured motorist (EUIM) coverage in the State and makes conforming changes. The first-named insured under a private passenger motor vehicle liability insurance policy may elect to obtain EUIM coverage instead of the uninsured motorist coverage. The bill is effective October 1, 2017 and is applicable to all private passenger automobile new business policies issued on and after July 1, 2018.

In response to the above, the Maryland Insurance Administration issued bulletin (attached), Private Passenger Motor Vehicle Liability Insurance – Enhanced Underinsured Motorist Coverage – Draft Proposed Form, requesting public comment prior to the form being entered into the Maryland Register. This form will be used for compliance with the changes contained in House Bill 5. Comments are to be submitted to Robert Baron, Associate Commissioner, P&C Unit at Robert.baron@maryland.gov by June 21, 2017.
