Oregon's Emergency Declaration Triggers HB 3272 Claims Provisions

As a result of the imminent and ongoing threat of wildfire, Oregon Governor Kate Brown issued Executive Order No. 22-17 on August 28, 2022 declaring a statewide state of emergency.

The emergency declaration triggers insurance provisions within Oregon House Bill 3272. Pursuant to same, if a homeowner insurance policy requires an insured to repair, rebuild, or replace damaged or lost property in order to collect the full replacement cost for the property, the insurer shall, among other things, and subject to the policy limits:

  • Provide the insured additional time to repair, rebuild, or replace damaged or lost property; and
  • Provide additional living expenses to an insured for a period of 24 months after the date of the damage or loss to the insured’s primary dwelling, if: (1) the damage or loss occurred in a location that was subject to an emergency declaration; and (2) the damage or loss is directly related to the emergency that was the subject of the declaration.

Oregon's state of emergency is in effect until November 1, 2022, or until it is rescinded by the Governor.
